Frequently Asked Questions

You can register your business name online at the Australia Securities and Investments Commissions (ASIC).

The ASIC has a lot of helpful tools that will guide you through making decisions such as what type of business entity to register as. It can also tell you what other types of business related forms you will need to complete.

After you run a search, you’ll be able to immediately register your business name – if available – and apply for a trade mark.

To register your business name, you’ll need an Australian Business Number (ABN).

You can apply for an ABN on its own before registering a business name or you can apply for a ABN at the same time you register your business name.

Either way, having an ABN is essential to opening and running a business in Australia.

Registering a business name at ASIC costs $36 for one year or $84 for three years.

In the case that the name you want for your business is unavailable, either because it is the same or similar to an existing name in the Australian business name database, you will have to get back to the drawing board and come up with another name option.

You can find the full Australian Government legislation on the Business Names Registration Act here.

You can trade mark the business name you choose so no one else can use it. That means you have full legal rights to build your business brand on the name you select.

Similarly, before you finalize your business name choice, run a trade mark search.

By running a search of trade marked names, you can avoid potential legal charges that can come from having a similar name.

Registering your business Domain/website

Don’t make the mistake of forgetting to check if the domain name is available for your business. The last thing you want is to register your business name and find out another competitor or company already has a website with your name!
