Contacting the local Secretary of State (SOS) office via Phone or Email is free and is the most reliable way to check your business name availability.

Online, you can search for Montana businesses entities via the Montana Business Search site (click here to visit), simply enter your business name into the “Starts With” field or you can access the official SOS database (click here to visit). When searching, enter the exact spelling of the business name you’re looking for, and keep in mind that the following name validation rules are applied to the name: words “the”, “an”, and “a” at the beginning of the name are ignored, spaces are ignored, special characters are ignored, upper and lower case is ignored, and business identifiers (e.g., corporation, incorporated, company, etc., or their abbreviation) are ignored. If “no results” are returned, you can try entering variations of the business name.

You can register your business name via ePass Montana and the Montana Small Business Development Center Network: Click here to visit and use this Start Up Guide to answer all of your questions. Useful information:

  • -All businesses (regardless of legal structure) conducting business under a name other than their full, true and correct name must file an Application for Assumed Business Name with the Montana Secretary of State’s Office
  • -All applicants must pay a $10 filing fee
  • -You must list the name, type, and location of your business, as well as the date you intend to start business
  • -The SOS website charges from $5 per document

To register your business name, you’ll need to do the following:

  • – If you choose to name your business as anything other than your own personal name then you’ll need to register it with the appropriate authorities
  • – This process is known as registering your “Doing Business As” (DBA) name
  • – A DBA name is a fictitious name (or assumed name, trade name or DBA name) is a business name that is different from your personal name, the names of your partners or the officially registered name of your LLC or corporation
  • – Montana requires a business name to be distinguishable in the records of the secretary of state from the name of another business currently on file.

  • – If you do not have a business name or are not ready to register your business name, you may reserve your business name for up to 120 days

If your ideal business name is already in use, you could still use a similar variant by gaining consent from the current entity and making a few minor changes to the name. Once you settle on a name you like, you need to protect it so that others can’t find it and claim it as their own. There are four different ways to register your business name:

  1. Entity name protects you at state level
  2. Trademark protects you at a federal level
  3. Doing Business As (DBA) doesn’t give legal protection, but might be legally required
  4. Domain name protects your business website address
